  • janine: ndkone--Thank you for your post. I wish you well over the summer months. My closest friend works as an $HR manager for IBM. It seems every time we speak she is preparing for another lay-off, and with this last one she really struggled as everyone who is still there is a good worker. Sad state of affairs for many good people.
  • ndkone: @bigbartabs - thanks, it means a lot knowing I am not alone. I watched the movie 'margin call' on a flight a few weeks before on a business trip.... man, I remember the scenes that the $HR staffs telling people their position is eliminated is almost the same. I know they are just doing their jobs... but man..... I had that live.... • eTradeBaby: @scorpino, I'm sure you're familiar with employee annual performance reviews and the section on "Needs Improvement" For all my reports I leave that section blank because adding anything there benefits nobody, including the company. $HR dept hate that, my reports love it! It's my annual battle every year with $HR managers, I don't budge on that issue. My team is productive. I also take all the "non-performers" from other teams, and funny how they become productive! My job is to set them up for success, not failure. I only focus on what they are good at doing, it's really easy managing people that way. Like my little example in trading, I don't give that employee (me) the responsibility to manually take a trade off, I let the good employee (me again) set the stop-loss order.

  • dirk: @cmac - a thought for you, the likely tax selling will come from the stocks that underperformed for the year in the indexes. Look at the dow-30, I think there were 5 down on the year. These would only be a trade for a Jan. bounce but remember that if they are down this year there is a reason for it and they may not get much of a bounce. Not my kind of trade but I do know others that do it. I remember $HR Block was one that was mentioned. good luck, Dirk

  • lizwaite: $MCP @ RFrangie I think this article from the $NY Times from back in April may help you to see the true nature of the rare earths crunch. There is also some history on Molycorp: http://www.nytimes.com/gwire/2010/04/12/12greenwire-global-scramble-looms-for-vital-clean-energy-m-53232.html?pagewanted=1 On September 30, the House passed $HR 6160 bill 325 to 98 called the Rare earths & Critical Materials Act. There was a huge spike in volume for $MCP that day also. • scottto: $AA - I disagree with your $HR department. $AA has been uptrending since the late Jan low. It's forming a nice base. There's a definable technical risk with the 50 and 200 EMAs supporting the action. I see 35 to 76 cents of downside and potentially $3 plus of upside. The real variable is with the end of quarter and we know $AA is one of the first to report (and usually disappoints in it's report). How has the macro situation improved for their business? Many reasons to employ this stock. I think they have a wrongful termination case here, maybe @Dan will represent them at trial. ;-) Cheers, @Scott
  • Jazman0013: I find being self aware critical to managing my risk. My most important rule is to sit out when my head is not in the game. This game is always a challenge but the impartiality of the market is a fantastic thing. Do you ever have to play politics with the market like you do at a day job? The market often rewards us for managing our risk and putting in constant effort. This is not to say there are no downdrafts! However, it is not because the market took you to $HR because your attitude was poor, you were late or etc. James

  • gordo: trading tax anyone now anything about this. maybe its been discussed here before? Back in February, U.S. Congressman Peter DeFazio introduced bill $HR 1068, "Let Wall Street Pay for Wall Street's Bailout Act of 2009." The proposed legislation imposes a 0.25% tax on all stock, bond, and option transactions. So anyone with the audacity to buy and sell 100 shares of Apple would pay about $50 in taxes for the round trip. you can sign the petition here http://www.rallycongress.com/no2tradertax/1536/
  • marquess: All, Anyone tracking FSYS? It is traveling along upper BB and although it had (4.8%) pull-back yesterday it almost has made that back this morning. I missed the gap-up this morning. I like the longer-term prospects and seems to be under accumulation from July lows (OBV steadily increasing). Also, good potential catalyst w/ $HR 1835(Nat Gas Act), post summer recess. And I also see #Cramer recently featured on his show. So question for team or @Dan: Since this gapped-up this morning how do we prevent chasing? Should one just wait for pull-backs intra-day to 20/50-day-MA to get in? Also like $HPQ, @Dan featured last night, not many red-candles(down-days) to build a position, since July. Assuming one wants to build position, how should we do w/ up-trending stock? (Already assuming suggested stop to be below, yesterday's intra-day low of $29.85.) Thanks, (newbie)@Kevin
  • brunario: This was reported in IBD yesterday. The provision is in SEC. 102 of the Bill introduced in the House. I think it is $HR 3200 which is entitlrd "America's Affordable Health Choices Act of 2009." The section is "Protecting The Choice To Keep Current Coverage." It, of course, does the opposite in the long run. It grandfathers existing plans and freezes them. Nothing new is allowed after the effective date of the Act. Therefore if there are any changes in circumstances no more private plans.

  • Bob: Hi Howard Certainly. RuthAnn and I were talking about her specific circumstances but in general I suggested: 1. Contact $HR or the person with the answers on going to cash or swapping 401K funds amongst those offered to see if there was any associated penalty or charge that might influence her decision. Don't assume, be sure. 2. The next was to take the list of funds available to her and find the stock symbols for each and then look at the charts. See if there are any that particularly standout as good or not so good. Her particular choices are pretty impressive. 3. If there is no penalty and it can be determined that there is a fund that makes more sense (say an index fund over an under performing sector) swapping to another with more potential growth may be a consideration. That was the basic conversation.
  • Searenity: $TC - Reads to me like time is on your side. However - living in fear is no way to live. I would not be worried about missing the bounce with an account like that. Move it to cash if you feel panic. I do question that you cannot allocate between funds. That is just plain wring if you ask me and you should discuss with your $HR people.
